All services are subject to a written agreement or accepted estimate before work begins.
All estimates are provided in writing and are valid for 30 days from the date of issue unless otherwise stated. An estimate is not a guaranteed price until both parties have signed a written contract or work order.
Actual project costs may change if site conditions differ materially from what was observed at the time of the estimate, if the scope of work changes at the customer's request, or if unforeseen issues are discovered during the project (such as underground utilities, unstable soil conditions, or pre-existing structural problems). We will notify you of any changes before proceeding with additional work.
Estimates do not include permit fees unless specifically stated. Permit fees are charged at cost and itemized separately.
Project start dates are scheduled after a written agreement is in place and any required deposit is received. We make every reasonable effort to begin work on the agreed date, but scheduling may be affected by weather, permit delays, material availability, or other factors beyond our control.
Concrete work in particular is weather-dependent. We reserve the right to reschedule a pour if weather conditions (including rain, extreme heat, or high winds) would compromise the quality of the finished work. We will notify you as early as possible if a reschedule is necessary.
If you need to cancel a scheduled project, please notify us as soon as possible. Cancellation terms, including any deposit forfeiture, will be outlined in your written agreement.
Payment terms are outlined in the written agreement for each project. We typically require a deposit before work begins, with the balance due upon completion unless otherwise agreed in writing.
Accepted payment methods will be specified in your written agreement. Late payments may be subject to a late fee as outlined in the agreement. If payment is not received within the timeframe specified, we reserve the right to suspend further work and pursue collection through lawful means.
Any disputes about an invoice must be raised in writing within 10 days of receipt. Failure to dispute within that period constitutes acceptance of the invoice amount.

We are not responsible for damage to unmarked underground utilities or for project delays caused by inaccurate customer-provided information.
Where a permit is required for your project under Brevard County or local municipal rules, we will apply for and manage the permit process on your behalf. Permit fees are passed through at cost. Work will not begin until required permits are in hand. You are responsible for any HOA approvals required before permits can be submitted. We are not liable for delays caused by permit processing times or HOA review timelines.
Any warranty applicable to your project will be specified in your written agreement. In general, we stand behind the quality of our workmanship for defects that result directly from our installation.

To the extent permitted by law, all services are provided "as is" with no warranties beyond those expressly stated in the written agreement.
To the fullest extent permitted by applicable law, Complete West Melbourne Concrete shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to our services or your use of our website, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from our services shall not exceed the amount paid by you for the specific project giving rise to the claim.

If informal resolution is not possible, disputes shall be resolved through binding arbitration in Brevard County, Florida, in accordance with the rules of the American Arbitration Association, unless both parties mutually agree to an alternative resolution method. Each party shall bear its own legal fees and costs unless the arbitrator determines otherwise.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought exclusively in the courts of Brevard County, Florida.
